Land Law in the Eritrean State

Land tenure is a fundamental and – at the same time – very sensitive issue in Africa. This is a common denominator in almost every part of the continent, and Eritrea is not an exception in this regard. The paper illustrates the development of land law in post-independence Eritrea, from the beginning of the development of the Eritrean legal system to the newly issued (but not yet in force) Civil Code. While illustrating the different developments of land tenure in Eritrea, the paper intends to show how traditional law continues to be the reference point for Eritreans with reference to land management, despite any legislative attempt to set it aside.

Does a land information system resolve land conflicts?

The absence of accurate land management arguably results in land conflicts as well as uncontrolled land use and conversion. The adoption of a land information system (LIS) might remedy such problems. Our study in rural Eastern Indonesia found that land management is a complex system involving various stakeholders, including the side of the local people and the side of the government. To some extent, an LIS is already in place but the actualised affordances it offers are limited because the system is hindered by numerous conflicts over uncertified land.

Traditions, Land Rights, and Local Welfare Creation: Studies from Eastern Indonesia

This research focuses on the impacts of traditional systems of land distribution among households, clans, and the government in two of Indonesia’s poorest provinces: East Nusa Tenggara and Maluku. Our main goal is to discuss and propose alternative ways of dividing and governing productive land to meet new needs in the management of agriculture and forestry. We apply a mixed research methodology that includes in-depth discussions with more than 50 key informants and survey interviews with 640 randomly selected respondents.
